New York Probate in 1896?

All right, question for the lawyers who know NY law.

First of all, let’s say a man dies in 1896 Troy without a will.  He is married but has no children.

What happens to the assets? I assume things go through probate?  Does someone from the family or from the state get declared an executor?

Any help/resources you can suggest would be very appreciated!
